Sorry I’m the same person as Yeeurr101 and I’m also sorry if I posted twice (new here) Hey man or men I’m back as I lost my fucking User name info… I have been trying to look for lawyers, it’s been 8 damn months and I can’t seem to get in contact or find the right lawyers, the people you said that got their account back with the lawyers? where did they go they must have been lucky because searching has been hell for me, I would appreciate anything as I’m desperate and I feel it’s unfair to me and if I sit on my ass and just let my account go to waste after all the money spent and an unfair ban, Thank you for the help.

I do not know which lawyers they used. If it were me though, I would start by googling "california consumer protection lawyers".

Im back lol im honestly starting to lose hope man I’ve been contacting law firms left and right but they seem confused about what I want to sue the game for “I say unfair ban some say they don’t have that type of attorney or whatever”, is it fair use?, I feel like I have to bribe somebody either the law firms or IMVU but I do not want to hear them in my ear telling me “there’s nothing we can do”, crap. those 2 people that got unbanned needs to share the law firm or whatever they found their attorneys at because this is getting ridiculous.

Tell the lawyers that the game removed your access to online assets that you paid for. That you either want the account back or all of the money you paid for the assets that are on it. You would want a consumer protection lawyer for that type of lawsuit, as I recommended before.

If I can add my two cents to this: I don't think the defense, or solution of getting money/value back would hold up, sadly. It's been a while since I read the general user TOS, but for creators at least, it specifically outlines that the license to use whatever you upload is theirs (pretty much indefinitely) and if you lose access through breach of TOS, they are under no obligation to reimburse you or the like. I recall that being the same for general users as well; if you get banned, you have zero right to any form of refund or reimbursement through their terms. Pretty standard company service stuff really, in the same way you won't get refunded a game if you get banned for cheating. Just made a lot worse by IMVU's modern habits and abusable report system. (And the largely incompetent customer support.)

It's more of an issue with IMVU, since it's reiterated in multiple forms in their TOS and they're so unjust with their bans. If I had to guess, I'd say they've updated those specific portions of the TOS in recent years to coincide with the stricter banning behavior and double-standards. It really gives them free reign to slap users around however they want, particularly creators. I do not agree with it ..but it's how they're set it up to cover their own ass.

You see, that's the beauty of it. Weather or not a TOS is to be upheld or not ... is up to the judge. The scummier a TOS is, the higher the chance a judge strikes it down. Does IMVU want to risk loosing their TOS presidence over 1 low value account, or do they want to render the case moot by giving him his account back?

OP doesn't need to win, he just needs to be enough of a headache to get what he wants. What he wants is pretty small and easy to do.

I have talked to “many lawyers” but this one guy and he was trying really hard to find legal basis of what I was asking for “digital access” IMVU says it is at my risk and the money is non refundable and that’s bullshit, he is really trying to help me but I think something is wrong here are they just scared to take them to court or is this like a thing where they cannot find a legal basis to sue them, do I HAVE to sue them in California? He says take it to a small claims court,(I also feel like I’m doing something wrong), am I supposed to be going for a proxy lawyer not a law firm. (I know I’ve been talking about this for a while now and my apologies if it’s getting to a point of a headache, I just really feel like shit is unfair at this point, and I don’t know what else to do)

You guys won’t believe what just happened so after all this bullshit of calling lawyers I said fuck it I’m finally going to call IMVU personally and they said hold on call us in one more hour I said okay and tells them yes my account was disabled and I liked to reactive it they say yes, she reactivated it and they put my account on hold again lol what the fuck just happened I swear these people are so scammy. So yes I have gotten my account back I thank you guys for all the help and I really appreciate it.
