We were already in the room and he rudely started stuff by comolaining about the tv so my mom told him to go to another room. I had a broom handle because the broom we had was already broken, i had no intentions on hitting him with it. I was about to go to my moms room to close the vent because the heat was blasting. But gary started being disrepectful to my mom trying to piss her off and ruin her mood. I only went to the room to tell him to lay down and be quiet cause what he was doing was ridiculous. I suffer from anxiety attacks. I do not get viilent when i get upset. I just helfld everything in for so long because its not my house and i was living there rent free. I cooked,cleaned and took care of the house in both my mom and his absence. I hadnt had my medicine in a while because theres one car and gary needs it 24/8 or our doctor appointments get canceled because he has to work. I was pebt up with years of mental and verbal abuse from him. So he shoved me and i told him not to touch me. So he decides to swing for my face. So i end up hitting him with the broom handle. I just snapped things let out to the hall because he kept hitting me in the head. I got knocked onto the wall so i threw a picture at him to try and defend myself. My mom stepped inbetween us while gary continued to insults and say vulgar things so i ran to get a knife because i was scared. My mom stopped me and knocked the knife out my hand and restrained me by pinning me to the floor. Which ended in him. Calling the police. He is a heavy alcoholoc with extreme anger problems. He was even in court for getting intoxicaded and slapping his youngest son on the head. He was supposed to quit drinking and go to anger management but did neither. He either spends what he makes on gambling or alcohal. I understand what i did was wrong and i take full responsibility for my own actions.

1) (a) A person is guilty of simple assault if he (i) attempts to cause or purposely, knowingly or recklessly causes bodily injury to another; (ii) negligently causes bodily injury to another with a deadly weapon or other means likely to produce death or serious bodily harm; or (iii) attempts by physical menace to put another in fear of imminent serious bodily harm; and, upon conviction, he shall be punished by a fine of not more than Five Hundred Dollars ($ 500.00) or by imprisonment in the county jail for not more than six (6) months, or both.
(b) However, a person convicted of simple assault upon any of the persons listed in subsection (14) of this section under the circumstances enumerated in subsection (14) shall be punished by a fine of not more than One Thousand Dollars ($ 1,000.00) or by imprisonment for not more than five (5) years, or both.
(2) (a) A person is guilty of aggravated assault if he (i) attempts to cause serious bodily injury to another, or causes such injury purposely, knowingly or recklessly under circumstances manifesting extreme indifference to the value of human life; (ii) attempts to cause or purposely or knowingly causes bodily injury to another with a deadly weapon or other means likely to produce death or serious bodily harm; or (iii) causes any injury to a child who is in the process of boarding or exiting a school bus in the course of a violation of Section 63-3-615; and, upon conviction, he shall be punished by imprisonment in the county jail for not more than one (1) year or in the Penitentiary for not more than twenty (20) years.
(b) However, a person convicted of aggravated assault upon any of the persons listed in subsection (14) of this section under the circumstances enumerated in subsection (14) shall be punished by a fine of not more than Five Thousand Dollars ($ 5,000.00) or by imprisonment for not more than thirty (30) years, or both
