Lawsuit Against IMVU for Modifying Audio Items

I'm a lawyer in California. Earlier this week, my law firm filed a class action lawsuit against IMVU for reducing the playback time of audio items. Among other things, we're asking the Court to require IMVU to reimburse affected users for the money they spent on these items.

I have been on IMVU since 06'.At first they disabled accounts for making "illegal" music products on there.Then gave the accounts back.Then customer service started helping those who were having issues with submitting the "illegal" products. When they were testing the music store I was picked to be one of the first to use it.I refused because it was in testing stage and I had to purchase the songs to test for them and I had to update to the newer client.
Then they came up with the first round of 20 sec limit to the music.The future music that was submitted was the only ones to be effected not the music made before a certain date.I was personally told by a IMVU staff member that the music that was made that was submitted before the date they had set,"WOULD NOT BE EFFECTED".This coming from an IMVU engineer that works on the updates in the client...
I would love to get my money back on the music items I had purchased in the past.......

Hi Todd,

I would suggest you to check some forums on IMVU because there are many opinions over there. Maybe it can help you better understand users' point of views and get your ground to win this lawsuit. There are also some debates going on there, but legal discussion is prohibited and was removed by IMVU MOD. (Another IMVU's rule) I personally think IMVU uses its TOS, which favors itself and can be revised anytime without notify, to transfer legal responsibility to its users/customers while knowingly making profits through it these years; however, its business practice needs to be judged.

That is right, the L word (Law) was banned from the IMVU forums. You are not allowed to talk about anything Law related on the IMVU forums, even if it is pro IMVU inc...or has nothing to do with IMVU. Their mods quickly delete anything that comes close. Still, yes, you can find allot of pissed off people on the IMVU forums.

I have so many links to provide all with all the facts you need about this matter. The way i see it... These products were approved in peer review, imvu has users doing peer review, IT IS IMVU's RESPONSIBILTY to pass products not users!! it is about danm time legal action is taken to get imvu to do their freken jobs. You have a very good "negligence" case against them the way i see it. Thinking about calling you directly.

I have been on imvu since 2007 and have seen so many changes in a lot of things now they made the music just 20 seconds and I have put a lot of money into a lot of things on imvu especially the music and like everyone else I think they should refund the credits spent on the music we have bought on imvu and not to mention how many credits I have bought since I have been on imvu. So now the only way we can hear music on imvu is with an radio or if you go to the music store and create a list and even if you do this there has to be a least you and one other person in the room before you are allowed to listen to it, so yes I will support this lawsuit.

Hello Todd, Been with IMVU since Jan / 2007 and have well over 1000 songs created. Having hundreds of hours put into my work to only have imvu disrupt my work and to re-do my inventory several times over the years now being left to spend many more hours trying to pull my songs from the catalog as their icons state NO TIME LIMIT. Unfortunately, imvu does not have an easy feature to do such which does create many more hours. I have plenty of my own funds into this site and are now redeemed useless. Not once pulling anything out for profit. We all stand beside you.

The Pdf supplied has nice verbage, I did not see a case number. If this has indeed been filed I would like to see a case number. I have lost hundreds of dollars due the NEW 20 second limit and so have several of my friends. IMVU needs to either reimburse, or pay the copy right fees as they should have been doing all along, they have made millions off of the audio products. THEY KILLED MY MUSIC, I CANCELLED MY VIP!! Everyone needs to cancel their VIP, This will hit them in them hard if we all cancel our VIP. WE WANT OUR MUSIC BACK!!!

im music developer for years im imvu ... over 1000 products .. i was selling a lot due to the high sound quality i was offering.. and of course since the lenght reduction i dont sell anymore..
to me .. the copyright its a excuse .. music business was so huge .. (millions every month) that imvu wanted the exclusivity of it... if the copyright was a real excuse they could have just ask the dev to put higher price or adjust the price themself and pay the copyright for their customers ... if they were really here for the customers and not only to make more and more money with OUR work.. this is bullshit honnestly .. all they see in the imvu users its the money they can make out of it... i hope this case is real and that something good will come from this :)
